Who you are buying from
This web site and the web site oztix.com.au (the "Oztix Website") are owned and operated by Ticket Solutions Pty Ltd (ACN 106907206) t/as Oztix of PO Box 476, Annerley, 4103, Queensland, Australia ( 'We', 'Our' or 'Us'). We operate this service on behalf of the artist, venue or event promoter ('Presenter') and tickets purchased from this site are purchased from Us as agent of the Presenter. Any dispute you have relating to an event or ticket purchase is between you and the Presenter and, as agent for the Presenter, We shall not be liable for any claims relating to an event or ticket purchase unless otherwise set out in these terms and conditions.

What you are agreeing to
By using or visiting this website you agree to be bound by these Terms and Conditions and Our Privacy Policy. Every ticket sold through this website is also subject to the Presenter's term and conditions and (which are usually available from the Presenter's website), any terms and conditions of the venue at which the relevant event is held and any terms and conditions that may be printed on the ticket.

Use of the Oztix Website
Use of this site is restricted to personal use and reference only.

Conditions of Sale
All Prices quoted are in Australian Dollars and include local taxes (GST).

Online sales will cease when the allocation of tickets is sold, at a time otherwise specified or usually 3 hours before doors open.

We and the Presenter reserve the right not to sell tickets to any person, agent or company.

Tickets will be delivered to you by the method you select during the booking process. If tickets are sent using Registered Post or a Courier service they will only be sent to addresses where the purchaser can sign for delivery. If you are not at home when the delivery representative calls, they will leave a card in your letterbox to advise you. Mail delivery option will cease to be offered 7~10 days before the event.

Tickets may not, without the prior consent of the Presenter, be resold or offered for resale at a premium over the face value of the ticket (including via on-line auction sites) or used for advertising, promoting or other commercial purposes (including competitions and trade promotions) or to enhance the demand for other goods or services either by the original purchaser from the Presenter or any subsequent ticket holder.

Note: your Credit Card statement will itemise a purchase as a charge from "Ticket Solutions Oztix Indooroopilly".

Refunds, exchanges, transfers
We do not refund, exchange or substitute tickets after purchase nor do We replace tickets that may have been stolen lost or destroyed, other than as set out in these terms and conditions. Please treat your tickets like cash as we cannot replace lost tickets.

Refund information for any cancelled or rescheduled event will be posted in the news section of www.oztix.com.au when applicable.

Cancelled Event
If an event is cancelled due to forces of nature, an act of terrorism or by forces outside of the control of the Promoter then a refund shall be at the discretion of the Presenter. If an event is cancelled for any other reason, please contact us in order to receive a refund.

Changes to Events
The Presenter reserves the right to alter the date, the venue and the entertainment and activities as advertised without prior notice and Your entitlement to a refund in such circumstances is set out below.

Events are occasionally rescheduled by the Presenter due to a variety of situations which may affect the performers, staff or audience. If an event is cancelled, please contact us in order to receive a refund.

If the date, time or venue of an event is rescheduled or changed, your ticket will remain valid for the rescheduled date, venue and time. If you cannot attend the rescheduled event or venue and you contact us in a timely manner and provide the original ticket(s) and proof of purchase, We will refund to you the ticket price inclusive of booking fees but exclusive of delivery or mail fees and or any Processing Surcharge. If you are entitled to a refund and We have not already mailed your ticket, then We will also refund you any delivery fee associated with the purchase of such Ticket(s).

If the headline act of an event is changed, your ticket will remain valid for the replacement act. If you no longer wish to attend the event due to the change in the headline act, and you contact us in a timely manner and provide the original ticket(s) and proof of purchase, We will refund to you the ticket price inclusive of booking fees but exclusive of delivery or mail fees and or any Processing Surcharge. If you are entitled to a refund and We have not already mailed your ticket, then We will also refund you any delivery fee associated with the purchase of such Ticket(s).

Supporting acts are subject to change or cancellation at any time without notice. If you contact us and provide us with reasons which demonstrate that such change or cancellation to the supporting act will have a material detrimental impact upon you, then we will refund to you the ticket price inclusive of booking fees but exclusive of delivery or mail fees and or any Processing Surcharge. If you are entitled to a refund and We have not already mailed your ticket, then We will also refund you any delivery fee associated with the purchase of such Ticket(s).

If the event is cancelled because of an act of war or terrorism or the forces of nature or by any event outside of the control of the Presenter then refunds shall be at the Presenter's absolute discretion. If the event is cancelled for any other reason, We will refund to you the ticket price (exclusive or inclusive of booking fees at the Presenters discretion) but always exclusive of any delivery or mail fees and the processing surcharge, upon request by you in a timely manner, provided that the original ticket(s) and proof of purchase are presented. Please contact us to request a refund.

Notwithstanding these terms and conditions, if You use a "disposable" or "temporary" credit card (such as those purchased over the counter at supermarkets) for Your online purchase We are not able to make any refund to you unless a) you can provide full details of the credit card; b) the credit card remains valid; and c) you can produce the online purchase receipt.

Any refund payable can only be made back to the credit card (whether temporary or otherwise) used in the original transaction.

No Show / Failure to collect tickets / Delivery fulfilment
We fulfil Our commitment to you for the sale of tickets by either mailing the ticket to you, emailing the Ticket to you or by making the ticket available at the door or Box Office for you to collect. If for any reason you are unable to collect all or part of your ticket(s) purchased from Us We are unable to refund your purchase. If you would like to enquire about any unusual circumstance that you believe may warrant a refund outside of the terms stated herein please contact us.

Pay Over Time Payment Option
If you accept an offer from Us to pay for your ticket over time, you agree that We can charge your specified credit card a deposit, a booking fee (if any) and the number of specified instalments prior to sending you a confirmed ticket. You agree that until you have paid the deposit, any booking fee and all instalments on the due date that you only have a reservation for a ticket and are not entitled to a ticket to the relevant event. If your credit card details change prior to your payment of any instalment, you agree to contact Us to update your credit card details. You agree that if, for any reason, We are not able to process any of the instalments on their due date, your reservation for a ticket will be cancelled and your deposit and any booking fee paid forfeited. We agree to repay any instalment (other than the deposit and any booking fee) you have paid to Us to the credit card you specified at the time of selecting the pay over time option, provided that credit card remains valid.

Changes to Terms and Conditions
The terms and conditions that apply to any particular transaction will be the published terms and conditions at the time the transaction was finalised. Subject to the preceding sentence, we may alter or change the terms and conditions as they appear on our website from time to time effective immediately from posting on the website. You should periodically check this page of the Oztix website to ensure that you are aware of the latest terms and conditions.

What happens if you have a inquiry or complaint
For inquiries or complaints regarding the sale and delivery of tickets please contact us on Tel. 1300 762 545. For inquiries or complaints regarding the staff and / or amenity of the venue at the event, please contact the venue management. For inquiries or complaints regarding the artist's performance, sound or lighting or production quality, please contact the Presenter.

Dispute resolution
If you have an issue with Our service or feel you have been unfairly treated please contact Us immediately. If you have already contacted Us and feel that you have not been fairly and reasonably treated, please contact Our customer service manager by email who will review your case.

Data Security
When We process your order We collect your credit card and personal information in keeping with Our Terms and Conditions and our Privacy Policy. We will endeavour to take all reasonable steps to keep secure all information that you provide to us. When processing your payment We use industry standard encryption software to encrypt all orders.

If you use Microsoft Internet Explorer (v. 5.0 and above), Netscape Navigator (v. 4.0 and above) AOL (v. 5.0 and above), Mozilla Firefox (1.0.2 and above) Opera (v. 5.0 and above) or another name-brand browser software your browser should be automatically configured to manage an SSL connection. Fraud
We use all reasonable endeavours to protect the interests and security of Our customers. When you Order tickets using our website We may record your host name, IP address and the time and date of the purchase to assure safety and security in completing any order via Our network. We may use this information to prosecute if fraud is suspected. This information is only collected for fraud prevention and will not be sold to any third party. Please see Our Privacy Policy for more information. We will email you upon receipt of your order, verifying your email address. Our on-line processing gateway automatically checks the database of your credit card provider for reported lost or stolen card numbers and to verify against information from credit card providers that informs Us of lost, stolen and continual or repeated chargeback credit card numbers or customers. We may also call you on the telephone to verify who you are. If we suspect fraud we may automatically refund Your order without notice.

If you deny or dispute a charge made by us please contact us immediately. We consider credit card fraud to be a serious offence and we aim to prosecute each case to the fullest extent possible. If you falsely dispute a charge or falsely deny a payment on your credit card We may start legal proceedings against you to recover the amount disputed, plus any costs incurred in collecting the proof or data required to ensure prosecution including international travel, hotel, car hire, fuel, meals etc and or any fees or costs relating to Our designated agent to appear in court.

Disclaimer and liability
You accept that the Internet is not always a reliable and that system outages may occur. Save to the extent set out in the Competition and Consumer Act 2012 (Cth) (including the consumer guarantees under Australian Consumer Law) or otherwise permitted by law, We will not be liable for any damages direct, incidental, consequential or otherwise, loss or corruption of data, loss of profits, goodwill, bargain or opportunity or loss of anticipated savings resulting from your access to, or use of, or inability to use the web site and its content, whether based in contract, tort, negligence, statute or any other legal theory, and whether or not We know of the possibility of such damage.

Choice of Law
These Terms and Conditions shall be governed by the laws of the State of Queensland, Australia but may be commenced in any Australian jurisdiction permitted under Australian law.

Australian Consumer Law
Our goods and services come with consumer guarantees that cannot be excluded under Australian Consumer Law. Those consumer guarantees apply in addition to any other express warranties which we provide under this Agreement. You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage.

Event Conditions of Sale and Admission

By entering the Venue you agree to abide by the following terms and conditions and when this ticket is purchased it is subject to the following terms and conditions of Opcon Pty Ltd ("Event Organiser"), these conditions apply to you both as conditions of sale and as conditions of admission to the event (mutually and exclusively); otherwise the following conditions apply as conditions of admission to the event;

All conditions shown here, on the ticket or ticket provider's website or sales outlet are to be read together with all other statements or directives either shown on this website or displayed at the venue or premises by the Event Organiser, its agents, contractors, employees or representatives.

'You' and 'your' refers to the customer. 'We', 'us', 'our' and 'Event organiser' refers to OPCON Pty Ltd. This agreement means these terms and conditions and any other conditions specified by us on our website / Facebook page /booking forms or ticket company provider's website or sales outlet.

Wristbands will be attached at the gate and must be worn at all times for the duration of the Event.

ID must be shown to prove legal age at the Festival entrance.

You acknowledge that neither we nor the venue will be responsible for any loss or damage to property (including personal property such as bags, money or other personal items) brought to or purchased at the Event by you or your invitees.

You will be liable for any loss or damage caused at the Event by you or your invitees.

You must ensure that you and your invitees act in an orderly manner when attending the Event. We may refuse entry or evict you or any of your invitees if they are behaving in a disorderly, offensive or inappropriate manner.

OPCON cares for the environment and community. Please be respectful and place any litter in the bins provided around the venue. Be waste and water wise – thank you.

Please respect our town and neighbours and do not create excessive noise or litter while travelling to and from the Event.

Patrons attending the event may be exposed to the following risks:
  1. Exposure to extreme weather conditions. This could potentially include exposure to direct sunlight, high temperatures, strong wind, heavy rain and hail, or low temperatures. Patrons are advised to be prepared for all weather conditions.
  2. Exposure to noise in the form of loud music.
  3. Exposure to large crowds or Patrons congregating around entertainment areas where accidents can potentially happen. UNDER THE CIVIL LIABILITIES ACT 2002 Division 5 - Dangerous recreational activities N).18, 19 & 20, GENERAL ADMISSION CROWDS CAUSE RECREATIONAL RISKS. PATRONS MUST ASSESS THEIR OWN RISK ON ENTRY
NO PASS OUTS PERMITTED

This is a non-smoking event, except in designated areas.

You agree to a search of your person or possessions being undertaken at time of entry, exit and at any time whilst inside the Venue. Prohibited items that are confiscated will not be returned.

You must not bring any of the following prohibited items into the Event venue and the following items will not be admitted;
  • No Scooters, skateboards, roller skates, roller blades, bicycles
  • No animals allowed (except for accredited assistance animals).
  • NO BYO alcohol.
  • NO BYO soft drinks.
  • NO BYO glass of any sort on site.
  • NO object that could be used to damage or vandalize the venue (This includes spray paint, advertising stickers, or chemicals used to damage natural flora)
  • NO object or device that could inhibit the ability for entertainers, staff, security or emergency services from performing their intended duties including, without limitation, whistles, loud hailer, public address system, bright light sources, laser pointers, or electronic devices which could broadcast or interfere with the festival operations.
  • No Illegal substances;
  • No Fireworks or explosives;
  • No Weapons
  • No Items which may obstruct the view of others or cause a public nuisance (including but not limited to umbrellas, tents, viewing platforms, whistles, laser pointers etc); or Items which may be used to create segregated or reserve viewing areas (including but not limited to rope, poles, temporary fencing or tarpaulins).
There are no BBQ's, open fires or naked flames permitted.

The Event Organiser reserves the right to refuse entry or evict anyone from the Event who behaves in a manner that reasonably interferes with other ticket holders' enjoyment or likely to cause damage, injury or annoyance. Anyone refused admission or ejected for these behaviours will not be allowed into the venue - nor will they have tickets refunded. These include but are not limited to the following circumstances;
  • if the ticket has been sold or used in breach of conditions;
  • if the ticket holder refuses to make their clothes, bags, containers or other possessions available for search by Security;
  • if the ticket holder is affected by the consumption of alcohol or drugs.
  • if the ticket holder participates in dangerous activities including aggressive dancing, moshing, stage diving, crowd surfing and climbing.
While attending the venue, Patrons must not:
  • Cause damage to, improperly use or tamper with any public facility, structure or building. Facilities including, without limitation, toilets, drinking fountains, rubbish disposal units, marquees, stages, scaffolding, temporary building, catering outlets, light towers, generators, water and electric infrastructure or fences.
  • Light or cause to be lit any fire (including barbecues)
  • Operate any event equipment (Generator, vehicle, sound and lighting system, two-way radio)
  • Exit the venue via routes other than the designated exit and emergency exit (when applicable) gates. This includes entering prohibited areas within the venue.
  • Cause any damage to flora and fauna on or surrounding the venue. This includes breaking branches and limbs or uprooting trees or plants, recklessly damaging grassed area, or contaminating any natural water storage.
  • Climb or attempt to climb any trees, natural features or structures, including, without limitation, fences, buildings, marquees, scaffolding, light tower, rubbish disposal units.
  • Throw or attempt to throw any bottle, stone, stick, or other object that could be used as a projectile anywhere inside or surrounding the venue.
  • Remove or attempt to remove any item or object from the venue or surrounding area.
  • Block or attempt to block any thoroughfare, gateway, passage, entry or exit point with either themselves or their property.
  • Litter in the venue or surrounding area. All rubbish is to be disposed of correctly in facilities provided.
  • Use any offensive or obscene language, whether in the presence or absence of other Patrons or staff.
  • Behave in a threatening or inappropriate manner (aggressive, riotous, abusive, or insulting actions) towards other Patrons or event staff.
  • Urinate or excrete in any place other than the facilities provided to carry out such activities.
  • Breach of the above conditions may result in the removal of the patron from the venue.
You must comply with all signs, instructions and directions of police, security personnel and officials.

A ticket may not, without the prior consent of the Event Organiser, be resold or offered for resale at a premium over the face value of the ticket (including via on-line auction sites) or used for advertising, promoting or other commercial purposes (including competitions and trade promotions) or to enhance the demand for other goods or services either by the original purchaser from the Event Organiser or any subsequent ticket holder.

If a ticket is sold or used in breach of this condition, the Event Organiser reserves the right to cancel the ticket without a refund. This ticket is only valid when purchased from official agents. Tickets bought from other sources may be refused entry.

The Event Organiser reserves the right to enforce published ticket purchase limits and cancel any tickets obtained above said limits by any one customer.

If the event is cancelled by the Event Organiser for any reason, only the face value of the ticket may be refunded. If Event Organiser deems it necessary to abandon the event due to the forces of nature or any other reason, refund of the face value of the ticket at our absolute discretion.

Save as required by law, tickets will not be replaced nor money refunded after purchase. Duplicate tickets will not be issued for lost, stolen or damaged tickets. The Event Organiser does not offer refund in the event of lost, stolen or damaged tickets or where the ticket holder cannot attend the festival due to reasons beyond the Festival's control.

The Event Organiser reserves the right to add, withdraw or substitute any performers or activities associated with the Event, vary programs, seating arrangements and capacities and determine and publish additional conditions from time to time. In the event of change of the date or line-up, refunds will not be available.

The event will continue rain, hail, snow or sunshine. Cancellation will only occur if conditions are deemed dangerous.

The festival is licensed. Any Patron wishing to consume alcohol must have photographic ID. We reserve the right to evict patrons who disobey or break Responsible Service of alcohol legislation and the law.

VIP tickets are strictly 18+. No one under the age of 18 will be allowed to enter the VIP area. Everyone must provide photo ID to enter the VIP area. NO exceptions will be made regardless of circumstance.

Anyone found to be supplying or buying alcohol for a minor will be evicted from the premises and face criminal charges.

Anyone found supplying or consuming illicit drugs will be evicted from the premises and face criminal charges.

The event is all ages. Children Under 12 enter free of charge provided they are under the supervision of a responsible parent/guardian over the age of 18.

Minors must be supervised by an adult at all times. If you are bringing a minor into the Venue you will be responsible for their safety.

You forever release and indemnify the Event Organiser, and its associated entities, including but not limited to their employees, contractors, agents, officers, officials, representatives from any loss, damage, claim, demand, action or other liability, threatened or incurred, or otherwise whatsoever arising out of any injury, death or loss or damage to property arising out of your attendance at the Event and any and all associated events and activities.

To the fullest extent permitted by law, we do not accept liability of any nature for the acts, omissions or default of those providing services in connection with the Event or any liability for any injury, damage, loss, delay or additional expenses which are incurred at or in association with this Event. In no event will we be liable for any indirect, consequential, exemplary or special damages.

The words "BASIN CONCERT SERIES", is a Registered Business and the Basin Concert Series logo and artwork and associated materials, assets and goodwill are works that cannot be used without the prior written consent of the Event Organiser.

You must not engage in any promotional, advertising, merchandising or marketing activities whatsoever at or near the Event Venue without the prior written authorisation of the Promoter. Any assets made in this regard shall be confiscated by the Promoter.

Audio or visual recordings of the Event are prohibited. Still cameras (not professional) are permitted but images may only be used for private purposes and not public display. By attending the Event, You consent to being included in any film and/or sound recordings of the Event that may take place and agree for these recordings to be used by the Event organiser.

In the case of an emergency evacuation or situation, you must follow all official directives.

If you feel at any time you or anyone else's health or safety is threatened, you should contact the nearest security guard. There are St John's Ambulance Officers on site at all times who can be contacted by security.

These terms and conditions are governed by the laws of Tasmania, Australia.

If any item in these Conditions of Entry is unenforceable, illegal or void then it is severed and the rest of the Conditions of Entry remain in force. These conditions may be supplemented by additional conditions at any time.
